These Terms of Service (“Terms”) govern your access to and use of CostCare AI (the “Service”), provided by CostCare AI Limited (“CostCare”, “we”, “us”).
By creating an account, signing an order form, or using the Service, you agree to these Terms on behalf of your organization (“Customer”, “you”). If you do not agree, do not use the Service.
CostCare AI is a B2B AI CRM that helps businesses manage client communications across channels and may generate suggested or automated responses through AI. The Service may include features for messaging, voice calls, call recordings/transcripts, CRM records, and integrations.
Customer Content includes messages, call data, recordings, transcripts, CRM records, contact data, and any content you or your end-customers provide through the Service.
DPA: Our Data Processing Addendum is available at /dpa and may be incorporated into your agreement.
You are responsible for ensuring your use of the Service complies with applicable laws and third-party platform policies, including:
We may provide settings or templates (e.g., “this call may be recorded”), but you control whether and how to use them.
You must not use the Service to:
We may suspend or terminate accounts for violations or to protect the Service, other customers, or end-users.
Pricing is subscription-based and may depend on message volume and/or other usage metrics as described in your plan or order form. You agree to pay fees and applicable taxes.
We may change pricing with prior notice for renewals or future periods.
We offer refunds within 30 days for eligible purchases. Refund eligibility may depend on your plan, usage, and the nature of the request. To request a refund, contact support@costcare.ai.
Usage/overage fees and third-party pass-through costs (e.g., telephony) may be non-refundable where applicable.
We target 99% monthly uptime, excluding planned maintenance, force majeure, and issues caused by third-party services or integrations outside our reasonable control. Support is provided via support@costcare.ai.
Each party may receive confidential information from the other. Each party agrees to protect the other’s confidential information and use it only to perform under these Terms.
We own the Service, software, and related intellectual property, excluding Customer Content. You may not reverse engineer or copy the Service except as permitted by law.
The Service may integrate with third-party platforms (e.g., Meta/WhatsApp/Instagram, Twilio). Your use of those third-party services is governed by their terms and policies. We are not responsible for third-party services.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COSTCARE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
OUR TOTAL LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE FEES YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
You will indemnify and hold us harmless from claims arising out of your Customer Content, your use of the Service, or your violation of laws/platform policies (including messaging/recording consent obligations).
These Terms are governed by the laws of Ukraine, without regard to conflict of laws principles. Courts located in Ukraine will have jurisdiction, unless otherwise required by mandatory law.
We may update these Terms from time to time. We will post updated Terms and update the “Last updated” date. Material changes will be communicated through the Service or email where feasible.
